Acceso a información sensible en el Gobierno de la Ciudad Autónoma de Buenos Aires (GCABA): elaboración de procedimientos para el uso de datos sanitarios en áreas de gestión

In the Autonomous City of Buenos Aires (CABA), the implementation of the Electronic Health Record (EHR) since 2016 has raised ethical and legal challenges related to the use of sensitive health data. Although Argentina's legal framework (Laws 25.326, 26.529, and Provision 7/2008) establishes guidelines for data access, use, and confidentiality, regulatory gaps persist—especially regarding the management of nominalized data for operational or strategic purposes. The GOGIES handles data requests from various actors. In 2024, facing increasing demands from central-level areas for access to nominal data on topics such as dengue, diabetes, and medication use, GOGIES developed a formal procedure. It includes confidentiality agreements and requires applicants to identify data managers, team members, and the intended purpose of use. This initiative aims to strengthen data protection, formalize access channels, and promote ethical, transparent, and secure data handling. This paper describes the implementation of the procedure and analyzes its initial results.
