This work addresses the introduction of non-imputability through Section 34 of Criminal Code in Argentina as well as the concept of dangerousness as an important factor to decide whether to grant freedom or not. Moreover, it includes a case that questioned the psychoanalytical perspective on the concept of non-imputability.
