Abstract

The study argues that the activist perspective of the trial is required by the modern constitucionalism for the thorough recognition of the essential rights. Through a shallow analysis of some decisiones of the Supreme Court of Justicy of the Nation of the last years, it shall be possible to conclude that the Judge –taking into account the obliging character of the trial and the right to an appropriate standard of living- must necessarely play an active role.
