Artificial intelligence in the Brazilian Public Administration: Legal interpretation under the precautionary and democratic principle
Keywords:
Public Administration, precautionary, legal, artificial intelligenceAbstract
The article interprets the paragraph VII of the art. 24 of the Brazilian Federal Law N. 14.129/2021, that determines the public policy management is accomplished through the “data intelligence on a digital platform”. The scope of artificial intelligence (AI) is investigated in the Public Administration based on the precautionary, publicity, motivation and democratic principles. It’s concluded that, despite the importance of the AI and considering the current stage of Its development, It can’t be used by the Public Administration in subjects that can cause irreversible damage or that require the exercise of discretionary powers, since It ends up producing unprecedented decisions, without the possibility of prior control.
