Abstract

Power is one of the most historically analyzed figures or elements, product of its unquestionable presence within relations, both social and legal. Various treatments have been offered to this figure, the constitutional is the most important of these, hence it has to be born, legitimized and act in harmony with other powers equally founded, with clear and delimited mechanisms that serve as control, avoiding excesses or arbitrariness in its exercise and with this an imbalance in the system. The present work seeks to synthesize the most relevant theoretical-legal foundations of this figure, and its obligatory link with the Constitution of a State, as a true legitimation instrument in which, in addition, the efficient mechanisms for its control must be established, which it closes the circle of life through which power must pass.

Professor of Constitutional Law. Vice-president of the Provincial Board of Directors of the National Union of Jurists of Cuba in Ciego de Avila. President of the Provincial Chapter of Constitutional and Administrative Law of the National Union of Jurists of Cuba in Ciego de Avila.
Dianet García Alvarez
