Genealogy and Criticism: from Michel Foucault to Enrique Marí

Abstract

The field of critical studies in law is currently wide and diverse. This responds to different historical reasons and to the very logic with which this current was formed. Although it is impossible to treat it as a homogeneous whole, it is possible to account for some common elements or marks, at least in the local sphere. In this sense, the influence of Michel Foucault does not go unnoticed. That is why in this work I intend to show the influence that Michel Foucault has had on the work of Enrique Marí, a pioneering author who is central to the critical legal-philosophical perspective in Argentina. In particular, I will show how genealogy as a method and criticism, with the specific characteristics attributed to it by Foucault, are re appropriated in some of Marí's works to analyze specific problems in the field of philosophy of law. I understand that the perspective that emerges from the use of these tools continues to be fully valid for thinking about contemporary problems of Law and enables absolutely relevant lines of work.
