Abstract

The paper gives reasons to state that the application of the doctrine of Suspicious Categories can be extended to the guarantee of Non Regressiveness that governs Economic, Social, Cultural and Environmental Rights (ESCER). In this respect, the article aims to take advantage of an already widely developed principle and, thus, could lead to a more effective protection of the ESCR by establishing at the head of the State the obligation to demonstrate that the regressive measure is not unconstitutional.
