Abstract

The negotiation process' involves a last objective: promote international cooperation and coordination, also maintain or restore international peace and security. Among the different means of peaceful solution, negotiation is the main choice of States to regulate and conduct international relations, since it is distinguished from other means, because it lacks the participation of third parties and reinforces the concept of State consent. Definitely, the negotiation is central to diplomacy and the pursuit of foreign policy objectives. With this theoretical framework we will analyze the negotiation and its interpretation by the International Court of Justice, including its examination of the so-called “obligation to negotiate”.
