American Court of Human Rights and indigenous territorial rights. Impact study of judgments

Abstract

For more than ten years, the Inter-American Commission on Human Rights and the Inter- American Court of Human Rights, bodies that make up the Inter-American System for the Protection of Human Rights have been developing a rich and innovative jurisprudence on the right to Indian collectively owned, even in the face of the lack of a conventional instrument in the region that expressly protect that right. This paper does not attempt to systematize or reproduce the above jurisprudential advances, but rather stand on the procedural stage of compliance with the judgments of the Court and try to realize the extent to which their decisions were effectively enforced and that strategies or instruments used the Court to do so.
