Abstract

It is an achievement of modern societies equal rights between people, enshrined in the Constitution and other laws; self-determination of the individual to choose to act or not to perform; you simply sell or donate goods; go freely before a public official and perform a legal act for the benefit of himself or another person. The problem is when the person suffers from a mental condition resulting from a disease or simply aging, a fact to which almost all are bound, and lacks sufficient mental capacity to discern how this act can cause damage present or future. We often find legal processes where the alleged affected is a person who has a mental deficiency to discern or predict the results of their actions capacity; protective and preventive role of law would be one more reason if we counteract these loopholes by establishing more expeditious and specific judicial procedures for such cases, which are increasingly more frequent.
