Abstract

The original action of unconstitutionality stands as one of the procedural tools that the Constitutional System of Buenos Aires possesses for the exercise of constitutionality control. This action —contemplated in Article 161 inc. 1 of the Buenos Aires Constitution— allows the Supreme Court of the Province of Buenos Aires, in a direct and original way, to issue on the constitutionality of laws, decrees, ordinances and all kinds of rules that constitute an abstract and general mandate. Its inclusion, represents a characteristic feature of the historical Constitution of Buenos Aires, and is one of its pillars in the breadth of ways to guarantee constitutional supremacy in the Province.
