“Between the text and the reality”. International human rights standard, are useful for women?

Abstract

Some authors (Lagarde, 2013, Facio, 2011) suggest that in the 1990’s
decade a number of years of feminist struggle against patriarchy were consagrated in the international human rights law. At the same time, other scholars (Segato, 2017) sustains that those laws had not improved the life of women, in particular, in relation to women´s rights to live a life free from violence. In this article, my argument says that international human rights standards are a tool that improve the life of some women´s survivors of gender-based violence, either through leading international human rights jurisprudence that impacts on creating public policies that benefit women as a social group, or by the possibility to apply for political asylum.
