The "law of repentance" and the "extinction of domain": A humanist reading against utilitarianism

Abstract

The objective of this article is to analyze two new institutes in the Argentine Law, the "Law of the Repentant" and the "Extinction of domain", and its relationship with the guarantees enshrined in our National Constitution. We will study, in the first place, the relationship maintained by the "Repentant Law" with the so-called "premial right", and we will present an investigation of the "Repentant Law" and its antecedents in Argentina and comparative law, to try to elucidate its legal nature and study its usefulness as a legal instrument. We will analyze, in turn, the so-called "Extinction of domain" and try to determine whether or not it is unconstitutional.
