The judicialization of politics. Proposal of a sociological approach to a political phenomenon that impacts the legal field

This paper will address a social political phenomenon that impacts legal sciences, proposing a look from the social sciences. It is about the judicialization of politics and lawfare, trying to understand the relationship between political power and the legal field, based on the use of Pierre Bourdieu's theoretical categories (social space, social field, legal field, habitus, illusio, legal capital, symbolic effect, ignorance effect). An attempt will be made to outline an answer to the question: What is the relationship between the power field and the legal field in the current government in Argentina? For this, I will develop a structuralist hypothesis –relation of the fields of power and legal-, together with a constructivist explanation - lack of the habitus typical of the legal field by the main officials of the Executive Power-. Finally, I will give an account of the existence of research projects in line with the argumentation exposed that are developed within the framework of the Faculty of Legal and Social Sciences of the National University of La Plata as a theoretical alternative methodological proposal in the construction of a critical teaching of the right.
