La violencia doméstica contra la mujer después del advenimiento de la Ley contra la violencia en Brasil, Ley “Maria da Penha”

Abstract

Domestic violence is a socio-cultural problem that affects thousands of people around the world. This article reveals this fascinating and controversial problem, that causes harmful consequences for society and family. It is necessary the public recognition of this socialcultural illness that affects an exorbitant number of women every year. Create effective mechanisms to protect women is the duty of the Brazilian state, as well established in Article 226, of the Federal Constitution of Brazil. Domestic violence against women is very costly both for the victim, which can hurt physically, socially and psychologically, and the whole family, the basic structure of a society. In this perspective, and to comply with human rights treaties ratified by the country, was approved on August 7, 2006 by President Luiz Inacio Lula da Silva, the Law No. 11 340, named Maria da Penha, that law contains a number of mechanisms that caused numerous changes in the judicial process. This law, in fact, meet the aspirations of the people, creates specific protection measures for victims and their families, punish offenders more severely, as well as encourage the promotion of public policies for women.
