Inyección supervisada en Vancouver: entre una batalla legal y una cuestión humanitaria

Abstract

Located in Vancouver, British Columbia, Insite was the first supervised injection facility in North America. The story behind Insite is comprised of a complex and interconnected series of events that led to the necessity to establish this center in 2003 as a respond to injection drug-related issues in Downtown Eastside. Despite the initial cooperation between the local and federal governments to set up Insite, it has recently faced a legal battle to remain open. Finally, last year the Supreme Court of Canada unanimously ruled in its favour stating that not allowing the clinic to operate under an exemption from drug laws would be a violation of the Charter of Rights and Freedoms. The aim of this article is to link the legal case with the local context and activism out of which the legal argument sprang, highlighting how important the social and economic background turned out to be for the final judicial decision
