Abstract

Often, the conventional study of the punish uses divide in a philosophy spheare –that it would try to justify the reason and describe the conjuncture in which itself goes back aceptable-, in other sociology –that searches disembowed the relationship between the punish and that what compose society: institutions, production ways, power regime, solidarity bow, cultures kinds-, and at last in a penologic –that indagate about the concret administration of the punishment in a community that have especialities agent for that, for example the penitentiary system, liberated patronage, etc.-. So well, in general these three lines of investigation take like reference to the law for their analysis, would be to glorificated or would be to criticated. In this article, and since of the F. Kafka´s propotitions we will try to do a no-juridical critic to the punishment law that our societies have, now that to erosion a social practice so taken root like the punishwe relieve necesary served, no only of the cited Tools, but apply to others news ones like it is the case of the literature. And this is because in the Kafka´s literature devines spring of resistence and creativity, without kind of compromise respecto of the dominant raise of the law, but that to be foreign to the legal-punish world, it is in need of responsability, of own identity. With the checo writter we can impugn the punish without to be taken by the homogeneous discourse that they go back aceptable.
