Abstract

The right to develop, besides being a new generation right, is an essential a priori for the establishment of a robust system of rights and guarantees. As a consequence this right represents a priority for Latin America and all emerging countries and those that are still developing countries. This concept of development involves in addition to tangible material conditions (assets and services), all actions that foster deployment of productivity and creativity of available human resources. In the last few decades international organizations and in particular the UN have enacted legal recognition of such rights linked to the Program of Development as a forerunner of the resolution of the conflicts that also involves a change in mentality and conscience, in addition to the necessary legal transformations. In this path the processes for supranational integration would became an adequate channel for the protection of rights emanating from the fundamental rights to develop not only of individuals but also of societies.
